These Guidelines (hereinafter referred to as the "Guidelines") stipulate the rules for the use of communication platforms (hereinafter referred to as the "Services") provided by Xtra, Inc. (hereinafter referred to as the "We" and "Us").

Users using this service should comply with these guidelines.

1. General Provisions

(i) This service is a community service provided by us for the purpose of interaction between users.
(ii) Users are deemed to have consented to the provisions of these Guidelines by using the Services. Any manifestation of disagreement with these Guidelines shall only be permitted without the use of the Services.
(iii) We may change these Guidelines at any time. Users should refer to this guideline whenever using this service.

2. User Posting

(i) The User shall represent and warrant to us that it does not infringe any rights of any third party with respect to the content and content of the posting and that it has all rights and authorities including copyrights.
(ii) The content and content posted by the User cannot be edited, changed, or deleted, even if requested by the User who submitted it, unless there are special circumstances.
(iii) The User shall not post any contents that violate the prohibitions stated in this guideline when submitting the posting.
(iv) Copyright and other rights relating to information posted by the User on the Services shall belong to the User or a duly authorized person. However, we may use the information posted on this service free of charge and without limitation (including any act of editing, copying, altering, adapting, reproducing, licensing or other use) in the services we provide.

3. Prohibited Matters

The User shall not engage in any of the following acts.

(i) Unauthorized access to the Services, such as unauthorized alteration or deletion of information on the Services.
(ii) Acts of writing or transmitting computer programs that are harmful to this service.
(iii) Acts that infringe on or are likely to infringe on the intellectual property rights, such as copyrights and trademark rights, confidential information on communications, property, privacy, portrait rights, reputation, or trust of third parties or ourselves. 
(iv) Reproduction, public transmission, distribution, adaptation, or use of information obtained through the Services for the purpose of generating profits without the permission of the right holder.
(v) Acts of posting advertisements or advertising for specific services, soliciting specific ideas concerning politics, religion, etc., or acts similar thereto on the Services.
(vi) Repeated posting of the same or similar content or repeated posting of unclear content.
(vii) Acts that place a burden on the server beyond the scope of normal use.
(viii) Any other act that infringes or may infringe our rights or interests.

4. Rules for Posting

The User shall not post any information on the Services including the following: If we determine that the information posted to the Services by the User falls under any of the following, we may delete, edit or take any other action that we deem necessary.

(i) Information that users of the Services may feel uncomfortable, such as indecent, cruel, violent expressions
(ii) Information that may infringe on copyrights, trademark rights, privacy rights, reputation or other rights or interests of us or a third party. 
(iii) Details that disparage or discriminate against third parties and us, irrespective of whether they are individuals or organizations.
(iv) Other information that we judged to be inappropriate.​

5. Indemnification

(i) We provide only a forum for interaction between users with respect to this service. Accordingly, the User shall not be responsible for any content posted by the User on this service.
(ii) We shall not be liable for any problems such as infringement of rights between users or between users and third parties with respect to the content and content posted. In the event of any trouble or dispute between users or third parties with respect to the content or content posted, the User himself/herself shall settle such dispute at his/her own responsibility and expense.
In addition, if we incur expenses (including attorneys' fees) for the resolution of such troubles, the User shall indemnify us in full for such expenses.
(iii) We shall not be liable to compensate for any damage caused by the use of the Services by the User, except in the event of willful misconduct or gross negligence on the part of us. Even if we are liable for compensation, the extent of such liability shall be limited to normal damage incurred by the User.
(iv) We may, at our own discretion, temporarily suspend or abolish the Services. Please note in advance.

6. Governing Law and Jurisdiction

The governing law of these Guidelines shall be the laws of Japan, and any disputes relating to the Services shall be settled by the Tokyo District Court as the court of first instance with exclusive jurisdiction.
